§ I. Grant of authority.

  • Cable TV Fund VIII-C, its successors and assigns, hereby referred to as Grantee, be and it is hereby granted the right, privilege and authority to operate, maintain and carry on the business of community antenna television system for the reception and distribution of television signals and energy and frequency modulated radio, and further, the right, privilege and authority to transmit and/or distribute, by cable, of audio and visual signals of every type and nature which are not otherwise herein prohibited, in the City of Sulphur, Louisiana; and in order to do so, to construct, operate and maintain lines, cables, conduits, poles, wires and other fixtures whenever necessary, upon, along, over and under the streets, alleys, bridges and public places in the City of Sulphur, Louisiana, provided, however, that before construction or erecting of poles and/or underground facilities on any public place, grantee shall apply for and obtain permission to construct or erect said poles or underground facilities in the City of Sulphur.

    Grantee may use the poles maintained by the telephone and electric companies when and where such poles can be obtained provided satisfactory agreements can be entered into with said utility companies, in lieu of construction of its own poles in order to carry its cables, wires and conduits and other equipment that may be necessary in order to conduct its business in the City of Sulphur, Louisiana.
