§ 7. Commercial advertising by licensee.

  • City grants to licensee the privilege of installing commercial advertising on each bench placed and maintained along the City streets and/or other public places under this agreement. No obscene or X-rated cinema advertising nor advertisements for alcoholic beverage products shall be permitted on said benches. Furthermore, the City Council shall be the sole judge of the suitability of all advertising and the product advertised on any bench, and if the City Council disapproves of any such advertising material, same shall not be used and, if necessary, immediately removed by licensee at licensee's sole expense. Licensee agrees to be solely responsible for the advertising material and the content of all such advertising exhibited under this franchise, and further agrees to hold the City free and harmless from all blame and for any and all claims and causes of action by any other parties for and on account of the content of the advertising signs exhibited on the benches under the terms of this agreement; and the licensee further agrees to indemnify the City, should it be required by court or other legal proceedings to pay any judgment, court costs, fines or other legal expenses for and on account of any advertising signs exhibited on benches.
