 Appendix A. FRANCHISES
 Article II. JONES INTERCABLE, INC.

  § III. Compliance with rules of Federal Communications Commission.

  • This ordinance is issued in accordance with the provisions as required by Section 76.31 of the Rules of the Federal Communications Commission, as amended from time to time, which provisions are intended to affect full compliance with said Section.

    A.

    Cable TV Fund VIII-C will provide cable television service to the entire franchised area providing there is a minimum density of forty (40) homes per mile. In the event the density is less than forty (40) homes per cable mile, service will be provided but customers will be asked to pay an aid to construction charge for initial installation that amount that is in excess of $200.00 per customer served for main plant extension.

    B.

    Cable TV Fund VIII-C shall, as expeditiously as possible, investigate and resolve to the extent possible all complaints regarding quality of service, equipment malfunctions, and similar matters and correct the same and the company shall maintain a local business office. Such problems shall be resolved within 72 hours unless the cause is beyond the control of the operator.

    C.

    The operator will maintain a record of all written complaints and furnish the City with a quarterly report of all written complaints received by customers. The City's office of the City Attorney will have the primary responsibility for the continuing administration of the franchise and implementation of complaint procedures. Nature of the procedure for reporting and resolving complaints will be given to each subscriber within ninety (90) days of the passage of this ordinance. New subscribers will receive those written procedures along with their first billing statement.

    D.

    Any modifications of the provisions of 76.31 of the Rules of the Federal Communications resulting from amendment by the Federal Communications Commission shall be incorporated into this franchise within one (1) year of the adoption of the modification or at the time of the franchise renewal, whichever occurs first.

    E.

    The operator will be required to carry all local television signals on its basic cable service as required by the FCC.
